Mitchell Epner is a civil and criminal litigator with 30 years of experience in virtually all forms of litigation, including employment, entertainment, securities, intellectual property, trusts & estates and criminal. His criminal expertise spans across government enforcement, compliance, and federal and state white collar litigation.

Mr. Epner has participated in numerous high-profile cases and investigations throughout the country, including:

  • A series of victories for the controlling shareholders of Hudson News in $1 billion litigation against one of the 20 wealthiest individuals in the world;
  • Representation of the former Chief Revenue Officer and Chief Human Resources Officer of Silicon Valley Bank;
  • Representation of leading pharmaceutical companies in patent litigations regarding products with over $1 billion/year in sales;
  • Successful representation of independent film makers in disputes with a leading distributor;
  • Successful representation of a leading entertainment industry executive in arbitration against EGOT producer, leading to a sizable recovery;
  • Successful representation of an attorney sentenced on White Collar Criminal charges in the District of New Jersey, obtaining a non-incarcerative sentence;
  • Successful representation of executives of U.S.-based Japanese auto parts executives in the In Re Japanese Autoparts DOJ Anti-Trust investigation, with no charges filed against any client;
  • Victory in the United States Supreme Court in KSR International Co. v. Teleflex, Inc., 550 U.S. 398 (2007), considered one of the most important patent decisions of the last thirty years;
  • Successful representation of potential witnesses in an internationally publicized RICO case in the EDNY;
  • Successful representation of a Blackstone Group Managing Director, leading to dismissal of all criminal and civil charges; and
  • Successful representation of EMI in the Napster litigation, leading to a then-record recovery against Bertelsmann

He provides employment counsel to executives in financial services, luxury retail, medical, public relations, sports and other sectors.

From 2001 to 2004, Mr. Epner served as an Assistant United States Attorney for the District of New Jersey where he successfully prosecuted more than 150 cases, including numerous trial victories.  During his final year, he was lead attorney on alien sex trafficking and involuntary servitude cases, working in close coordination with attorneys from the Civil Rights Division of the Department of Justice.  Mr. Epner remains involved with non-government organizations fighting against sex trafficking, domestically and internationally.

Mr. Epner is frequently been asked to share his opinions on criminal and civil matters with leading media outlets.  He has been quoted in New York Times, Times (London), Forbes, Fortune, CNN, CNBC, Newsday, USA Today and leading publications in Europe, Asia and South America.  He has served as a paid contributor to the Daily Beast.  He has appeared as an on-air expert for CNN, CNBC, BBC, Sky News, NewsNation, CBC, and other broadcasters in Australia and Europe. He also has appeared on numerous podcasts, including Serious Trouble, Opening Arguments, Law and Chaos and Objections.

Mr. Epner is committed to community service. He has served as the Treasurer and Secretary of the Sepsis Alliance, Interim Treasurer and Secretary of Eleanor’s Legacy and a member of the Dartmouth College Alumni Council. In his youth, Mr. Epner was a member of the Jones Beach Lifeguard Corps  and was the first runner-up in the 1987 Jeopardy! Teen Tournament.
